1 The contract between us
We must receive payment of the whole of the price for the goods that you order before your order can be accepted. Once payment has been received by us we will confirm that your order has been accepted by sending an email to you at the email address you provide in your order form. Our acceptance of your order brings into existence a legally binding contract between us.

2 Ownership of rights
All rights, including copyright, in this website are owned by or licensed to PMIQ Limited. Any use of this website or its contents, including copying or storing it or them in whole or part, other than for your own personal, non commercial use, is prohibited without our permission. You may not modify, distribute or re-post anything on this website for any purpose. All materials supplied remain the property of PMIQ until payment is received in full. Copyright exists on all materials supplied in any form. Copying, transfer or storage by whatever means may only be performed with the express written permission of PMIQ.

3 Accuracy of content
We have taken care in the preparation of the content of this website, in particular to ensure that prices quoted are correct at the time of publishing and that all goods have been fairly described. However, orders will only be accepted if there are no material errors in the description of the goods or their prices as advertised on this website. Any weights, dimensions and capacities given about the goods are approximate only.

4 Damage to your computer
We try to ensure that this website is free from viruses or defects. However, we cannot guarantee that your use of this website or any websites accessible through it will not cause damage to your computer. It is your responsibility to ensure that the right equipment is available to use the website. Except in the case of negligence on our part, we will not be liable to any person for any loss or damage which may arise to computer equipment as a result of using this website.

5 Availability
All orders are subject to acceptance and availability. If the Goods you have ordered are not available from stock, we will contact you by e-mail or phone (if you have given us details). You will have the option either to wait until the item is available from stock or to cancel your order. If the owner/ accrediting body for any of the courses that we offer either terminates, retires or upgrades the course material and associated examination requirements, we reserve the right to reduce your course duration and impose a completion date earlier than previously agreed. If we need to take this action, we will write to you via email to inform you of your new course expiry date in line with the changes being imposed, giving you notice of at least one month of the change to allow you sufficient time to complete the course and exams. In such circumstances, PMIQ will not be held liable for any refund payment to clients.

6 Ordering errors
You are able to correct errors on your order up to the point on which you click on “submit” during the ordering process.

7 Price
The prices payable for goods that you order are as set out in our website. All prices are exclusive of VAT and are correct at the time of entering information. Wherever it is not possible to accept your order to buy goods of the specification and description at the price indicated, we will advise you by email, offer to sell you the goods of the specification and description at the price stated in the email and will state the period for which the offer or the price remains valid.

8 Payment terms
We will charge your credit account for payment upon receipt of your order unless delivery cannot be fulfilled within 30 days. We accept no liability if a delivery is delayed because you did not give us the correct payment details. If it is not possible to obtain full payment for the goods from your account then we can cancel the contract and or suspend any further deliveries to you. This does not affect any other rights we may have.  For late payments, the Customer will be liable to payment of interest accruing daily at the rate being 4 percent above the Bank of England base rate from the date when payment first became due until the date of actual payment both before and after any judgement. All interest is payable to us on demand.  If a Customer continues to withhold payment, further action will be taken which may include legal action to recover the monies.

9 Delivery
9.1 Our delivery charges are included in the prices shown in our website.
9.2 We will deliver the goods to the address you specify for delivery in your order. It is important that this address is accurate. Please be precise about where you would like the goods left if you are out when we deliver. Shipment will be by standard Royal Mail (not tracked) unless otherwise specified and agreed with the client. We cannot accept any liability for any loss or damage to the goods once they have been delivered in accordance with your delivery instructions (unless this is caused by our negligence). We will aim to deliver the goods by the date quoted for delivery but delivery times are not guaranteed. Clients can purchase a tracked international shipment at additional cost if they so desire. If delivery is delayed due to any cause beyond our reasonable control, the delivery date will be extended by a reasonable period and we will contact you to arrange an alternative time.
9.3 You will become the owner of the goods you have ordered when they have been delivered to you. Once goods have been delivered to you they will be held at your own risk and we will not be liable for their loss or destruction.

10 Risk and ownership
Risk of damage to or loss of the goods passes to you at the time of delivery to you, or if you fail to take delivery at the agreed time, the time when we tried to deliver. You will only own the goods once they have been successfully delivered and when we have received cleared payment in full. Goods supplied are not for resale.

11 Acknowledgement and acceptance of your order
You will need to provide us with your e-mail address and we will notify you by e-mail as soon as possible to confirm receipt of your order and e-mail you again to confirm details. An acceptance of your order will take place on despatch of the good(s) ordered.

12 Cancellation rights
12.1 Under the Distance Selling Regulations you have the legal right to cancel your order within seven days of receipt of your goods (with the exception of any made to order items). You do not need to give us any reason for canceling your contract nor will you have to pay any penalty. However, you will need to notify us if you wish to cancel your contract.
12.2 You cannot cancel your contract if you have taken any audio or video recording or computer software out of the sealed package in which it was delivered to you, or if you have accessed any online content that forms part of your purchase.
12.3 If you have received the goods before you cancel your contract then (unless, under clause 12.2, for which you do not have a right to cancel) you must send the goods back to our contact address at your own cost and risk. If you cancel your contract but we have already processed the goods for delivery you must not unpack the goods when they are received by you and you must send the goods back to us at our contact address at your own cost and risk as soon as possible.
12.4 Once you have notified us that you are cancelling your contract, any sum debited to us from your credit card will be re-credited to your account as soon as possible and in any event within 30 days of your order PROVIDED THAT the goods in question are returned by you and received by us in the condition they were in when delivered to you. If you do not return the goods delivered to you or do not pay the costs of delivery, we will be entitled to deduct the direct costs of recovering the goods from the amount to be re-credited to you.
12.5 You will be re-credited for the costs incurred in returning faulty or unsatisfactory goods.
12.6 For e-learning training courses, you have the right to cancel your contract within the first seven days of receipt of your goods, although you cannot cancel your contract if you have accessed any of the pre-course or course material. Beyond the seven day period, it is not possible to cancel your contract. No refunds will be issued.
12.7 For public training courses, the following cancellation charges will apply:
Cancellation:
Greater than 28 days from the course start date 10% of the full cost
14-28 days from the course start date 50% of the full cost
Less than 14 days from the course start date 100% of the full cost
Transfer of purchase to another PMIQ Course:
Greater than 28 days from the course start date No Charge
14-28 days from the course start date 25% of the full cost
Less than 14 days from the course start date 50% of the full cost

12.8 For corporate training courses, the following cancellation charges will apply:
Cancellation:
Greater than 28 days from the course start date 10% of the full cost
14-28 days from the course start date 50% of the full cost
Less than 14 days from the course start date 100% of the full cost
Transfer of purchase to another pmiQ Course:
Greater than 28 days from the course start date No Charge
14-28 days from the course start date 25% of the full cost
Less than 14 days from the course start date 50% of the full cost

12.9 Cancellation of examinations:
Over 30 days = 0% of exam fee
15-30 days = 5% of exam, fee
8-14 days = 75% of exam fee
7 days or less = 100% of exam fee

13 Cancellation by us
13.1 We reserve the right to cancel the contract between us if:
13.1.1 We have insufficient stock to deliver the goods you have ordered
13.1.2 We do not deliver to your area; or
13.1.3 One or more of the goods you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers.
13.2 If we do cancel your contract we will notify you by e-mail and will re-credit to your account any sum deducted by us from your credit card as soon as possible but in any event within 30 days.
13.3 PMIQ reserve the right to cancel or re-schedule any public course. Delegates that are not able to attend a ‘re-scheduled’ course will receive a full refund, less the value of any non-returned or opened materials. Whilst we will try to ensure that any re-scheduled courses are held at the same location, we cannot guarantee that this will be possible.
13.4 If the owner/ accrediting body for any of the courses that we offer either terminates, retires or upgrades the course material and associated examination requirements, we reserve the right to reduce your course duration and impose a completion date earlier than previously agreed. If we need to take this action, we will write to you via email to inform you of your new course expiry date in line with the changes being imposed, giving you notice of at least one month of the change to allow you sufficient time to complete the course and exams. 14 Liability
14.1 If you do not receive goods ordered by you within 30 days of the date on which you ordered them, we will have no liability to you unless you notify us in writing at our contact address of the problem within 60 days of the date on which you ordered the goods (unless this is not reasonably practicable).
If you notify a problem to us under this condition, our only obligation will be, at your option:
14.1.1 to make good any shortage or non-delivery;
14.1.2 to replace or repair any goods that are damaged or defective; or
14.1.3 to refund to you the amount paid by you for the goods in question in whatever way we choose.
14.2 Both parties shall only be liable under this contract for losses, which are a reasonably foreseeable consequence of the relevant breach of contract
14.3 You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase goods from our site. The importation or exportation of certain of our goods to you may be prohibited by certain national laws. We make no representation and accept no liability in respect of the export or import of the goods you purchase.
14.4 Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.

15 Notices
Unless otherwise expressly stated in these terms and conditions, all notices from you to us must be in writing and sent to our contact address at Hermes House, Fire Fly Avenue, Swindon, Wiltshire SN2 2GA and all notices from us to you will be displayed on our website from time to time.

16 Changes to legal notices
We reserve the right to change these terms and conditions from time to time and you should look through them as often as possible.

17 Law, jurisdiction and language
This website, any content contained therein and any contract brought into being as a result of usage of this website are governed by and construed in accordance with English law. Parties to any such contract agree to submit to the exclusive jurisdiction of the courts of England and Wales. All contracts are concluded in English.

18 Invalidity
If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected.

19 Privacy
You acknowledge and agree to be bound by the terms of our privacy policy.

20 Third party rights
Nothing in this Agreement is intended to, nor shall it confer any rights on a third party.

21 PMIQ Guaranteed Pass scheme
The PMIQ Guaranteed Pass scheme has the following restrictions:
21.1 The PMIQ Guaranteed Pass scheme applies only to the PRINCE2 Foundation examination.
21.2 The PMIQ Guaranteed Pass scheme applies only if a candidate fails to pass the PRINCE2 Foundation examination on their first attempt. PMIQ will pay for the candidates second attempt, but will not be responsible for payment of any further attempts beyond this.
21.3 The candidate must sit both their first and second examination attempts through PMIQ to qualify for the PMIQ Guaranteed Pass scheme.
21.4 The candidate must have completed a PMIQ PRINCE2 Foundation course to qualify for the PMIQ Guaranteed Pass scheme.
21.5 The PMIQ Guaranteed Pass scheme is not valid for candidates that have had their examination revoked by APMG for whatever reason.

22 Corporate courses
22.1 If a Corporate client provides the training venue, the following facilities should be available as a minimum:
– Tables and chairs that can be arranged ‘U-shaped’ for training and ‘Classroom-style’ for examinations.
– LCD/LED projector and screen.
– A1 flip-chart or white-board with coloured pens.
– Refreshments (tea, coffee, water, etc.)
– Toilet facilities
– Power sockets for a laptop and projector.
PMIQ reserve the right to cancel the course if, in the opinion of pmiQ, the venue is unsuitable.
22.2 The client shall provide PMIQ with details of delegates attending a course at least 2 weeks prior to the commencement of the event to allow PMIQ to register delegates for the examinations.
22.3 Subsistence and any other expenses incurred whilst executing a client’s business, whether at the client’s premises or elsewhere are charged in addition.
22.4 Car mileage is charged at 40p per mile.
22.5 Air/ rail will be charged at standard class fares as appropriate. Where a single flight is expected to last longer than six hours, Business/Club class may be used.
22.6 Where necessary, a courier will be used to dispatch course material/pre-course work to the venue. This will be charged back at cost.
22.7 If any additional costs need to be incurred as part of delivering the service to the client, agreement will be obtained before any expenditure is incurred.

23 e-Learning courses
23.1 PMIQ e-Leaning courses are valid for a 12 month period from the date of purchase. There will be an additional renewal charge payable for any extension to this period.
23.2 Any updates to the course material will be provided at no additional cost within the 12 month period.
23.3 All examinations purchased as part of PMIQ e-Learning courses are valid for 12 months from the date of purchase. Following the 12 month period, replacement exams can be purchased from PMIQ at the price shown on our website. Additional costs associated with taking the examination(s) outside of the UK (for example, at a British Council Building) will incur additional charges. Also, online examinations (for example, those using the Remote Proctor Pro or Remote Proctor Now method) will incur additional charges to cover APMG administration and shipping costs.. All additional costs are shown on our website.
22.4 The e-Learning courses have been designed to operate on desktop systems to the following minimum specifications:-
Windows7®
Windows Vista® ( Home Premium, Business, Ultimate or Enterprise )
Windows XP® or XP Tablet Edition (Machine spec. Intel® Pentium® P4 2GHz, 1GB RAM)
MAC OSX 10.4.11, 10.5.4 and above (Intel Core™ Duo 1.83GHz or PowerPC® G4 1GHz, 512MB RAM)
The latest version of Adobe Flash must be installed on the computer.
We recommend a minimum screen resolution of 1200 x 800 pixels
The courses are not currently compatible with mobile devices (e.g. iPad, iPhone, tablets, etc.).

22.5 Support will be provided by e-mail in the first instance. Telephone support will be available for any issues that cannot be resolved via e-mail.
23.6 All purchases made on pmiq.resolutionlabs.co.uk may be returned within 7 days of purchase for a full refund. This excludes e-Learning products which have been accessed by the user.

22.6 For purchases made using the payment plan option where the cost of the course is spread over 3, 6 or 12 months, the user is responsible for all monthly payments, regardless of whether or not they complete the course or take the examinations.  If payments are not made within a month of the due date, users will be unenrolled from the course until such times as all outstanding payments are made. For late payments, the Customer will be liable to payment of interest accruing daily at the rate being 4 percent above the Bank of England base rate from the date when payment first became due until the date of actual payment both before and after any judgement. All interest is payable to us on demand.  If a Customer continues to withhold payment, further action will be taken which may include legal action to recover the monies.

24 Public courses
24.1 PMIQ reserves the right to change the location of any course, and in the unlikely event that this is required, PMIQ will advise the customer as soon as this change is known. In exceptional circumstances that are beyond our control, we reserve the right to transfer public course delegates to the equivalent live virtual or online (e-learning) course.
